Notice Regarding Janus Decision

In the wake of the Supreme Court Decision in Janus v. American Federation of State, County, and Municipal Employees, Council, 585 U. S. ____ (2018), the Court stated that employees must “opt-in” to public unions and automatic agency shop fee deductions are a violation of an employee’s First Amendment rights of Freedom of Speech and Freedom of Association when done even temporarily without a showing of clear and affirmative informed consent by an employee.  New Jersey’s Workplace Democracy Act is being reviewed by the Attorney General in the wake of the Janus decision.  New Jersey law precludes Boards from advising employees regarding union matters.
